Corby rapist to appeal his sentence at Royal Courts of Justice today

A Corby man who was jailed for four-and-a-half years for raping a young girl is set to appeal his sentence today (Friday, October 30).

The 12-year-old girl, who was too young to consent, fell pregnant and had to have a termination.

A DNA test after the abortion showed Carley to be the girl’s rapist.

The girl suffered bullying at school from those who said she had made up the allegation and the court was told the offence had had a ‘profound’ effect on her.

Carley was sentenced to four-and-a-half years by His Honour Recorder David Herbert QC at Northampton Crown Court in July 2019. He was told he would only have to serve 27 months of the sentence. He will therefore be eligible for release next October.

The usual sentence for similar crimes is about eight to ten years but but the judge at the sentencing hearing said that the defendant’s young age, positive character references and early guilty plea meant that he would impose a lesser sentence.

The court was told that in the four years since Carley’s offence, he had found work, had matured and had not reoffended

The court was also told by Carley’s barrister that a delay in hearing the case of four years was a matter of national shame, the result of an ailing justice system that has since worsened and has become the subject of a barrage of publicity.

His case was also delayed by another police investigation into the alleged rape of another girl by Carley which was never brought to court..

He will appeal the sentence today in The Court of Appeal at the Royal Courts of Justice in The Strand, London, before Mrs Justice Cutts DBE and Sir Nicolas Blake.
