Motorists with up to 23 points on their driving licences have been allowed to keep on driving by Northamptonshire courts.

One 43-year-old from Wellingborough with 23 points on his licence is still driving, despite the legal limit for a driving ban being 12 points.

A man aged 45 from Kettering is also still on the roads with 20 points on his licence and a 26-year-old man, also from Kettering, is still driving with 19 points.

The figures were revealed to the Northants Telegraph following a request to the DVLA for the release of the statistics under the Freedom of Information Act.

Normally, there would be an automatic driving ban under totting-up rules when a driver reaches 12 points on their licence.

But the offender can go to court to try to persuade magistrates that they would face exceptional hardship if they faced a driving ban.

The latest offence from the driver with the most points in the north of the county – the man from Wellingborough with 23 points – was a speeding offence in a 30mph area which carries a penalty of three to six points.

This means that he must have already had at least 17 points on his licence when he persuaded the court not to ban him.

No further details on his identity were released by the DVLA.

There was only one female in the top 10 list – a woman from Northampton with 18 points on her licence.

There was no-one from Corby or East Northamptonshire on the list.

Micaila Williams, head of employment at Seatons solicitors, which has branches across north Northamptonshire, said: “Exceptional hardship is ordinarily exceptionally hard to prove.

“Defendants need to show more than just the normal consequences that flow from the ban like loss of employment.

“In reality the courts are more interested in how the driver’s ban would affect others.

“Having committed the offence the driver is the one that needs to be punished and suffer the consequences of his own actions.

“However, the ripple effect of the ban on others who have no culpability at all bears heavily on the mind of the court.

“For example, if by a ban the driver would lose significant business and others would lose their job then this may amount to exceptional hardship.

“Additionally, the impact of a driving ban on elderly relatives and children will be an important consideration.

“As a note of caution whatever exceptional reason advanced and accepted by the court cannot be used again for another three years.”
