The court heard that Mr Amani had laid down on the road when he was hit by Jones’s Toyota.

Andrew Howarth, mitigating, said Jones believed Mr Amani was clearly “very drunk” and his client had believed that what he saw in the road was a “bin bag”.

His Honour Judge Rupert Mayo said it was not a case that warranted a jail sentence.

Jones, of Portcullis Road, Leicester, pleaded guilty to causing the death of Mr Amani by careless or inconsiderate driving. He will be sentenced next month.
